("Apple") has not undertaken an exhaustive search and analysis of its patent portfolio (the "Apple Patents"), it believes that U.S. Patent Numbers 4,661,902 and 4,689,786 may be necessary for an implementation of material contained in http://ietf.org/rfc/rfc2642.txt (the "Document"). In the event that the technology discussed in the Document becomes and IETF standard (the "Standard") which is not materially different from the Document, Apple agrees, upon written request from a Party, to negotiate outside of IETF to make available a non-exclusive license under reasonable and non-discriminatory ("RAND") terms and conditions under such claims of the Apple Patents to the extent necessary to implement a product compliant with the Standard. These RAND terms and conditiond may be conditional upon a reciprocal grant or defensive use.
